Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of barutti.ae (the “Site”), your purchases made online through the Site, and your purchases made at the physical retail stores of Mario Barutti Trading (L.L.C) (“Mario Barutti”, “we”, “us”, “our”). By accessing the Site, placing an order, or buying from our stores, you confirm that you have read, understood and agree to be bound by these Terms in full. If you do not agree, please do not use the Site or purchase from us.

1. Definitions

“Consumer” means a natural person who acquires a product or service for a purpose not related to trade. “Order” means a request submitted by you to purchase products. “Products” means the menswear, tailoring, alteration services and related goods we offer. “We/Us/Our” means Mario Barutti Trading (L.L.C), a company registered in Dubai, United Arab Emirates, TRN 100006834400003. “You” means the person accessing the Site or purchasing from us.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under UAE law to place an Order or buy from us. By transacting with us you confirm that you meet these requirements and that all information you provide is accurate and complete.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. The Site, its content and functionality are provided for your personal, non-commercial use.

4. Prohibited Uses

You agree that you will not: (a) use the Site in any way that breaches applicable law; (b) attempt to gain unauthorised access to the Site, its servers or any connected system; (c) use any robot, spider, scraper or automated means to access, copy or monitor the Site or its data; (d) reverse-engineer, decompile or attempt to extract the source code of the Site; (e) introduce any virus, malware or other harmful material; (f) upload content that is unlawful, defamatory, infringing or malicious; (g) impersonate any person or misrepresent your identity; (h) interfere with the proper working of the Site, including through denial-of-service attacks; or (i) create, operate or assist any counterfeit, spoofed or imitation website using our brand, content or imagery. We may suspend or terminate your access for any breach and reserve all legal remedies.

5. Products, Descriptions & Variation

We take care to describe and display our Products accurately, including colours, fabrics, leather and finishes. However, actual colours may vary depending on your screen or lighting, and minor variations in cloth, pattern, grain, texture and finish are natural characteristics of tailored garments and leather goods. Such variations are not defects. Product images are for illustration; accessories shown for styling are not included unless stated.

6. Availability & Stock Shortages

All Products are subject to availability. We do not guarantee that any Product shown on the Site is in stock. If a Product becomes unavailable after you place an Order, we will notify you and may cancel the affected item or the Order and refund any amount paid for it. We are not liable to you beyond that refund.

7. Pricing, Pricing Errors & VAT

All prices are displayed in UAE Dirhams (AED) and are inclusive of Value Added Tax (VAT) where applicable. Our TRN is 100006834400003. A valid VAT invoice is available on request. Despite our best efforts, a Product may occasionally be mispriced. Where the correct price is higher than the price shown, we may, before dispatch, contact you for instructions or cancel the Order and refund any amount paid. We are not obliged to supply a Product at an incorrect price. We may change prices at any time without notice, but changes do not affect Orders we have already accepted.

8. Orders & Order Acceptance

Your Order is an offer to purchase. All Orders are subject to our acceptance. A binding contract is formed only when we confirm dispatch of your Order (for delivery) or hand the Product to you (in store). We may, at our sole discretion, accept, limit, decline or cancel any Order — including where the Product is unavailable, where we suspect fraud or error, or where you have a history of abusive returns or chargebacks — and will refund any payment made for a cancelled Order.

9. Order Verification & Fraud Prevention

To protect against fraud, we may carry out verification checks before accepting or dispatching an Order, including confirming your identity, billing details or payment method. We may decline or cancel any Order that fails these checks. You agree to provide accurate information and to co-operate with reasonable verification requests.

10. Chargebacks

If you initiate a chargeback or payment dispute that we consider unjustified (for example, for an Order you received and retained), we reserve the right to contest it, to recover the amount and reasonable costs from you, and to suspend your ability to order from us.

11. No Commercial Resale

Our Products are sold for personal use only. You may not purchase Products for commercial resale, and we may cancel Orders that we reasonably believe are placed for resale or in unusual quantities.

12. Payment

Payment must be made in full at checkout, in store, or via Cash on Delivery where offered. Online payments are processed by secure third-party payment providers; we do not store your full card details. We do not impose a surcharge for card payments. Title to the Product passes to you only on full payment.

13. Cash on Delivery

Cash on Delivery (COD) is available for eligible Orders within the UAE for a handling fee of AED 15, shown at checkout. Payment must be made in full to the courier on delivery. We may withdraw COD for any Order or customer at our discretion.

14. Gift Cards & Store Credit

Gift cards and store credit are issued at our discretion, are non-refundable, cannot be exchanged for cash, and may carry an expiry date where permitted by law. They can be used only towards purchases from Mario Barutti. Lost or stolen gift cards cannot be replaced. We are not liable for unauthorised use of a gift card.

15. Promotions, Discounts & Coupon Abuse

Discount codes and promotions are offered at our discretion, may be limited to one use per customer, have no cash value, cannot be combined unless stated, and may be withdrawn or amended at any time. We may cancel any Order where a code is used fraudulently, in bad faith, or in breach of its terms (“coupon abuse”).

16. Shipping & Delivery

We deliver across the UAE, the GCC and internationally on request. Delivery timeframes shown are estimates only and are not guaranteed. We are not liable for delays caused by couriers, customs, force majeure, or incorrect or incomplete delivery information you provide.

17. Failed Delivery, Wrong Address & Refused Delivery

You are responsible for providing a correct and complete delivery address and for being available to receive the Order. Where delivery fails because of an incorrect address, your unavailability, or refusal to accept the Order, we may charge you the additional delivery costs incurred, and any re-delivery may be subject to a further charge.

18. Partial & Split Shipments

We may fulfil your Order in one or more shipments. Where an Order is split, you will not be charged additional delivery fees beyond those shown at checkout unless agreed.

19. Risk of Loss

Risk of loss or damage to the Products passes to you upon delivery to you or to a person you nominate, or upon collection in store. For COD orders, risk passes on delivery.

20. International Shipping & Customs

For international Orders, you are the importer of record. Any customs duties, taxes or charges levied by the destination country are your responsibility and are payable by you in addition to the price and delivery fee. We are not responsible for customs delays.

21. Returns, Refunds & Exchanges

For change-of-mind purchases, we offer an exchange or store credit (rather than a cash refund) on Products returned unworn, unwashed and in original condition with tags attached, within 7 days of delivery, in person at either Mario Barutti branch. The full terms are set out in our Returns, Refund and Exchange policies, which form part of these Terms.

22. Faulty Products & Your Statutory Rights

If a Product is defective, damaged or not as described, you are entitled under the UAE Consumer Protection Law (Federal Law No. 15 of 2020 and its Executive Regulations, Cabinet Decision No. 66 of 2023) to a repair, replacement or full refund, at no cost to you. These statutory rights cannot be waived or limited by these Terms or by any of our policies. Nothing in these Terms affects your mandatory rights as a Consumer under UAE law.

23. Tailoring, Alterations & Measurements

We offer in-house tailoring and alteration services. For Products purchased online, minor alterations (such as hemming of sleeves and trousers, and small waist or sleeve adjustments) are complimentary; more extensive work is a paid service, quoted and confirmed in advance. For Products purchased in store, alterations are a paid service, priced according to the work required. Alterations are carried out based on the measurements taken and the adjustments agreed at your fitting; where you provide measurements remotely, the alteration is performed on that basis and at your responsibility. We will not begin chargeable work until you confirm it.

24. Made-to-Measure & Personalised Products – Final Sale

Any Product that has been altered to your measurements, made to measure, made to order or personalised, as well as footwear and underwear/intimate apparel, is final sale and cannot be returned, exchanged or refunded for change of mind, sizing or fit — because the work is unique to you and the Product cannot be resold. The only exception is where the Product is genuinely faulty, in which case your statutory rights under UAE law apply.

25. Product & Leather Care

You are responsible for caring for your Product in accordance with any care guidance provided. Damage caused by improper care, wear and tear, or accidental damage is not a defect and is not covered by your statutory rights.

26. Intellectual Property, Trademarks & Photography

All content on the Site — including text, graphics, logos, product photography, layout and design — is owned by or licensed to Mario Barutti Trading (L.L.C) and is protected by intellectual-property laws. You may not copy, reproduce, distribute or use any content without our prior written consent. Brand names of products we stock remain the property of their respective owners; nothing on the Site grants you any right in those brands.

27. User Content & Reviews

If you submit any content to us (such as a review, photo or comment), you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with our business. You confirm that your content is accurate, lawful, and does not infringe any third party’s rights. We may remove any content at our discretion. Submitting false, misleading or fake reviews is prohibited.

28. Third-Party Services & Links

The Site may use or link to third-party services (such as payment, delivery and analytics providers). We are not responsible for the content, policies or practices of third-party services, and your use of them is at your own risk and subject to their terms.

29. Privacy & Data Protection

We handle your personal data in accordance with our Privacy Policy and the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021).

30. Electronic Communications

By transacting with us or providing your contact details, you consent to receive communications from us electronically (by email, SMS or WhatsApp) in connection with your Orders and our services. Marketing communications are sent only where you have opted in, and you may opt out at any time.

31. Security

We apply appropriate technical and organisational measures to protect the Site and your data, but no online system is completely secure. You are responsible for keeping your account credentials confidential.

32. Disclaimer of Warranties

The Site is provided “as is” and “as available”. We make no warranty that it will be uninterrupted, error-free or free of harmful components, except to the extent required by UAE law. This does not affect your statutory rights in respect of the Products.

33. Limitation of Liability

To the maximum extent permitted by UAE law, we are not liable for any indirect, incidental or consequential loss. Our total liability to you for any claim arising out of an Order is limited to the amount you paid for the relevant Product. Nothing in these Terms excludes or limits liability that cannot be excluded under UAE law, including liability for death or personal injury caused by our negligence, or your mandatory rights as a Consumer.

34. Indemnity

You agree to indemnify and hold harmless Mario Barutti Trading (L.L.C), its officers and employees, against any claims, losses or costs arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

35. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, civil unrest, epidemics, government action, utility or carrier failures, or internet outages.

36. Assignment

We may assign or transfer our rights and obligations under these Terms to another entity. You may not assign your rights without our prior written consent.

37. Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

38. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.

39. Survival

Provisions that by their nature should survive termination — including those on intellectual property, liability, indemnity and governing law — will continue to apply.

40. Entire Agreement

These Terms, together with the policies referenced in them, constitute the entire agreement between you and us and supersede any prior or verbal statements.

41. Changes to These Terms

We may update these Terms at any time. The version in force at the time of your Order applies to that Order. Continued use of the Site after changes constitutes acceptance.

42. Future Loyalty Programme

We may introduce a loyalty or rewards programme in future. Any such programme will be governed by its own terms, which will be made available when it launches.

43. Dispute Resolution, Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. We encourage you to contact us first to resolve any dispute amicably. Any dispute that cannot be resolved is subject to the exclusive jurisdiction of the courts of Dubai.

These Terms are provided for general information and do not constitute legal advice. We recommend that a licensed UAE lawyer reviews them before they are relied upon. In case of any conflict between the English and Arabic versions, the Arabic version shall prevail.
